Keen Rehabilitation, LLC d/b/a Keen Physical Therapy (“Keen Physical Therapy,” “KeenPT,” “we,” “our,” or “us”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information collected through our public website and related online communications.


This Privacy Policy applies to our public website. It does not replace our HIPAA Notice of Privacy Practices, which explains how we use and disclose protected health information in connection with physical therapy services.


1. Information We Collect

We may collect the following types of information:


Information you provide directly

When you contact us through our website, email us, call us, request information, subscribe to communications, or otherwise communicate with us, we may collect information such as your name, email address, phone number, message content, and any other information you choose to provide.


Please do not submit urgent, highly sensitive, or detailed medical information through our public website contact form. For patient intake forms, medical history, payment information, appointment management, and patient portal access, please use our patient portal or contact us directly.


Scheduling, portal, intake, payment, and patient information

Online booking, intake forms, medical history, payment processing, appointment reminders, and patient portal accounts are handled through JaneApp, our third-party practice management and patient portal provider. JaneApp may collect and process information needed to schedule appointments, manage intake forms, process payments, send appointment reminders, and support patient portal services.


Automatically collected information

When you visit our website, certain information may be collected automatically through cookies and similar technologies, such as your IP address, browser type, device information, pages visited, referring pages, and general website usage information.


We currently use GoDaddy’s built-in analytics and cookies to analyze website traffic and improve the website experience. We do not use advertising pixels or third-party behavioral advertising tools.


2. How We Use Information

We may use information we collect to:

  • Be  conversational or informational 
  • Respond to your questions or requests. 
  • Communicate with you about appointments, services, and clinic information. 
  • Provide, schedule, bill for, and manage physical therapy services. 
  • Send appointment reminders and patient communications. 
  • Send newsletters, marketing emails, or service-related announcements where permitted by law. 
  • Operate, maintain, secure, and improve our website. 
  • Analyze website traffic and user experience. 
  • Comply with legal, regulatory, accounting, and compliance obligations. 
  • Protect our rights, safety, patients, staff, website, and business operations. 


3. How We Disclose Information

We do not sell your personal information. We do not disclose your personal information for cross-context behavioral advertising.  No mobile information, phone numbers, and SMS consent data will not be  shared with third parties or affiliates for marketing or promotional  purposes. 


We may disclose information to:

  • Service providers that help us operate our website, scheduling systems, patient portal, communications, payment processing, analytics, and business operations. 
  • JaneApp and related vendors involved in appointment scheduling, intake forms, medical history, payments, appointment reminders, and patient portal accounts. 
  • Website hosting and analytics providers, including GoDaddy. 
  • Email, SMS, and communications vendors that help us communicate with patients and website visitors. 
  • Professional advisors, such as attorneys, accountants, consultants, and compliance professionals. 
  • Government authorities, regulators, courts, or other parties when required or permitted by law. 
  • Other parties with your consent or at your direction. 


If information is protected health information under HIPAA, we use and disclose it only as described in our HIPAA Notice of Privacy Practices and as permitted or required by law.


4. Cookies and Website Analytics

Our website uses cookies and similar technologies to analyze website traffic, understand how visitors use the website, and improve the website experience. You may be able to adjust your browser settings to refuse or delete cookies. Some website features may not function properly without cookies.


5. Email, Text Messages, and Marketing Communications

We may communicate with you by email, phone, or text (SMS) message, including for appointment reminders, scheduling, clinic updates, patient communications, for conversational or informational purposes, and marketing communications where permitted by law.  The text (SMS) messaging program consists of general conversational messaging to answer questions and provide support to customers. 


You may opt out of marketing emails by following the unsubscribe instructions in those emails. You may opt out of non-essential text messages by replying “STOP” where applicable or by contacting us directly. Transactional, appointment-related, billing-related, or care-related communications may still be sent where permitted by law.


Email and text messages may not always be fully secure. Please avoid sending sensitive medical information by regular email or text unless you understand and accept the risks.


No mobile information will be shared with third parties/affiliates for  marketing or promotional purposes. Text messaging originator opt-in data  and consent will not be shared with any third parties except vendors  supporting message delivery for our business purposes. 


We do not sell, share, rent, or transfer your personal information,  including phone numbers and SMS consent data, to external organizations  for marketing or any other purpose. 


You can cancel the SMS service at any time. Just text 'STOP' to the  phone number from which you received messages. After you send the SMS  message 'STOP' to us, we will send you an SMS message to confirm that  you have been unsubscribed. After this, you will no longer receive SMS  messages from us. If you want to join again, just sign up as you did the  first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you  from us and to us from you. Message frequency will vary based on  communication needs. If you have any questions about your text plan or  data plan, it is best to contact your wireless provider.

6. Minors

We provide services to minors. Information about minors should be provided by a parent, legal guardian, or other authorized personal representative, unless applicable law allows otherwise. Parents or guardians may contact us about privacy rights related to a minor’s information as permitted by law.


7. Data Retention

We retain information for as long as needed for clinic, legal, accounting, compliance, operational, and patient care purposes. Retention periods may vary depending on the type of information, legal requirements, business needs, and healthcare recordkeeping obligations.


8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect information. However, no website, email system, or electronic storage system can be guaranteed to be completely secure.


If we discover a security incident or breach involving personal information or protected health information, we will investigate and provide notices as required by applicable law.


9. Third-Party Websites and Services

Our website may link to third-party websites or services, including JaneApp and other external platforms. We are not responsible for the privacy practices of third-party websites or services. Please review their privacy policies and terms of use.


10. HIPAA and Health Information

Keen Physical Therapy is a healthcare provider and may maintain protected health information subject to HIPAA. Our use and disclosure of protected health information is described in our HIPAA Notice of Privacy Practices.


This Website Privacy Policy is intended to describe our public website privacy practices. If there is a conflict between this Privacy Policy and our HIPAA Notice of Privacy Practices regarding protected health information, the HIPAA Notice of Privacy Practices will control.


11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make changes, we will update the effective date above. Your continued use of our website after changes are posted means you acknowledge the updated Privacy Policy.

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.


Keen Rehabilitation, LLC d/b/a Keen Physical Therapy (“Keen Physical Therapy,” “KeenPT,” “we,” “our,” or “us”) is committed to protecting the privacy of your health information. This Notice applies to protected health information we create, receive, maintain, or transmit in connection with providing physical therapy services.


Your Rights

When it comes to your health information, you have certain rights. This section explains your rights and some of our responsibilities.


Get an electronic or paper copy of your medical record

You can ask to see or get an electronic or paper copy of your medical record and other health information we maintain about you. We will provide a copy or summary of your health information, usually within 30 days of your request. We may charge a reasonable, cost-based fee.


Ask us to correct your medical record

You can ask us to correct health information about you that you believe is incorrect or incomplete. We may deny your request in certain circumstances, but we will tell you why in writing.


Request confidential communications

You can ask us to contact you in a specific way, such as by home phone, cell phone, email, or mail, or to send mail to a different address. We will say “yes” to reasonable requests.

If you pay for a healthcare item or service out of pocket in full, you can ask us not to share information about that item or service with your health insurer for payment or operations purposes. We will agree unless a law requires us to share that information.


Get a list of those with whom we have shared information

You can ask for a list, called an accounting, of certain disclosures of your health information. This list will not include all disclosures, such as disclosures for treatment, payment, healthcare operations, and certain other disclosures excluded by law.

You can ask for a paper copy of this Notice at any time, even if you agreed to receive it electronically. We will provide a paper copy promptly.


Choose someone to act for you

If you have given someone medical power of attorney, or if someone is your legal guardian or authorized personal representative, that person may exercise your rights and make choices about your health information. We may verify the person’s authority before taking action.

For minors, a parent, legal guardian, or other authorized representative generally may exercise privacy rights on the minor’s behalf, subject to applicable law.


File a complaint if you believe your rights have been violated

You may file a complaint with us if you believe your privacy rights have been violated. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights.

We will not retaliate against you for filing a complaint.


Your Choices

For certain health information, you can tell us your choices about what we share. If you have a clear preference for how we share your information in the situations below, tell us what you want us to do.


You may choose whether we share information

You may tell us whether to:

  • Share      information with your family, close friends, caregivers, or others      involved in your care. 
  • Share      information in a disaster relief situation. 
  • Contact      you for certain communications. 

If you are unable to tell us your preference, for example if you are unconscious or unavailable, we may share information if we believe it is in your best interest. We may also share information when needed to lessen a serious and imminent threat to health or safety.


Marketing and sale of information

We will not sell your protected health information. We will not use or disclose your protected health information for marketing purposes unless permitted by law or unless you give us written authorization.


Our Uses and Disclosures

We typically use or share your health information in the following ways.


To treat you

We may use your health information and share it with other professionals who are treating you.


Example: We may share information with another healthcare provider involved in your care or use your medical history to develop your physical therapy plan of care.


To run our organization

We may use and share your health information to operate our clinic, improve care, manage our services, contact you when necessary, train staff, conduct quality reviews, and support business operations.


Example: We may use information about your treatment to review and improve the quality of care we provide.


To bill for services

We may use and share your health information to bill and receive payment for services we provide.


Example: We may share information with a payment processor, billing vendor, or health plan if applicable.


Appointment reminders and care communications

We may use and disclose your health information to contact you about appointments, reminders, treatment options, follow-up care, patient portal messages, or health-related services that may be of interest to you.


Business associates

We may share health information with vendors and service providers that perform services for us, such as practice management, scheduling, patient portal, payment processing, communications, records management, legal, accounting, and technology services. When required by HIPAA, we require these business associates to protect your health information.


Public health and safety

We may share health information for certain public health and safety purposes, such as:

  • Preventing      disease. 
  • Helping      with product recalls. 
  • Reporting      adverse reactions to medications or products. 
  • Reporting      suspected abuse, neglect, or domestic violence.

  • For      workers’ compensation claims.

  • With      health oversight agencies for activities authorized by law.

We may share health information in response to a court or administrative order, subpoena, discovery request, or other lawful process, subject to applicable legal requirements.


Research

We do not generally conduct research using patient health information. If we ever use or disclose health information for research, we will do so only as permitted by law or with your written authorization when required.


Medical examiners, coroners, and funeral directors

We may share health information with a coroner, medical examiner, or funeral director when permitted or required by law.


Substance use disorder records

To the extent we receive or maintain substance use disorder patient records protected by 42 CFR Part 2, we will use and disclose those records only as permitted by applicable law. Such records generally may not be used or disclosed in civil, criminal, administrative, or legislative proceedings against you without your written consent or a qualifying court order.


Uses and Disclosures That Require Written Authorization

We will ask for your written authorization before using or disclosing your health information for purposes not described in this Notice or otherwise permitted by law.

Your written authorization is generally required for:

  • Most      uses and disclosures of psychotherapy notes, if any. 
  • Uses      and disclosures of protected health information for marketing purposes,      except where permitted by law. 
  • Sale      of protected health information. 
  • Other      uses and disclosures not described in this Notice. 

If you give us written authorization, you may revoke it in writing at any time, except to the extent we have already relied on it.


Our Responsibilities

We are required by law to:

  • Maintain      the privacy and security of your protected health information. 
  • Provide      you with this Notice of our legal duties and privacy practices. 
  • Follow      the terms of the Notice currently in effect. 
  • Notify      you if a breach occurs that may have compromised the privacy or security      of your protected health information. 
  • Not      use or share your information other than as described in this Notice      unless you authorize us in writing. 


We do not sell your protected health information.


Changes to This Notice

We may change the terms of this Notice. Changes will apply to all health information we maintain, including information we created or received before the change. The new Notice will be available upon request, at our office, and on our website.
